Tackle & Trail provides outdoor gear, apparel, educational content, events, retreats, and guided outdoor experiences. These Terms apply to all users, customers, and participants interacting with our Services.

6. Cancellations, Refunds, and Transfers
Retreats, events, and experiences are subject to separate booking and cancellation policies.

By booking, you agree to those policies.
7. Assumption of Risk (Outdoor Activities)
Outdoor activities involve inherent risks, including but not limited to:

By participating, you voluntarily assume all risks associated with such activities.
Participation may require signing a separate liability waiver prior to the event.
8. Waiver Acknowledgment
By participating in any Tackle & Trail event, retreat, or outdoor experience, you acknowledge and agree that:

you will be required to review and sign a separate Liability Waiver and Assumption of Risk Agreement prior to participation

the waiver is intended to limit liability to the fullest extent permitted by law

your agreement to these Terms does not replace the waiver, but works together with it as part of your participation requirements
Failure to complete required waivers may result in denial of participation without refund.
9. Health and Safety
You are responsible for determining your fitness to participate in activities.
You agree to:

follow all safety instructions

disclose relevant medical conditions when required

act responsibly to protect yourself and others
We reserve the right to remove any participant for safety reasons without refund.
10. Intellectual Property
All content on this website, including text, images, branding, graphics, logos, and designs, is owned by Tackle & Trail or licensed to us.
You may not copy, reproduce, distribute, or use any content without prior written permission from Tackle and Trail.
11. User Content and Media
If you submit or share content (photos, videos, reviews, etc.):

No Class Actions: You agree to resolve disputes on an individual basis only and waive any right to participate in a class, collective, or representative action.

Arbitration Rules: Arbitration will be administered by a recognized arbitration provider under its applicable rules.

Location: Arbitration will take place in the State of Texas unless otherwise required by law.

Opt-Out: You may opt out of this arbitration provision within 30 days of first agreeing to these Terms by providing written notice to info@tackleandtrail.com.
17. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
Any disputes not subject to arbitration shall be resolved exclusively in courts located within Texas.
18. Entire Agreement and Severability
These Terms, together with any referenced policies (including Privacy Policy, Cookie Policy, Booking Terms, and applicable Waivers), constitute the entire agreement between you and Tackle & Trail regarding the Services and supersede any prior agreements or understandings.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

We may update these Terms from time to time.
